Scope

This privacy notice applies where Timothy Corcoran and the consultancy of Benefits Services process personal data about clients, employees of clients, suppliers and other third parties with whom there are business dealings in circumstances where a privacy notice specific to the circumstances has not already been issued.

Personal data provided will depend on the source of the information and may include the following:

Personal data provided and collected is only used for legitimate business purposes. This includes and is not limited to providing and improving services to clients, marketing, managing relationships with clients, potential clients and third parties, service provision and recruitment.

Client data use

Processing of personal data on behalf of clients will only be carried out in accordance with the client engagement and instructions. Processing of such personal data will normally be carried out in the role of data processor with the client acting as data controller.

Legal basis

The legal basis for processing personal data is normally contractual to reflect client engagement and provision of services.

In some cases, legitimate interest may be a consideration for processing personal data.

Where appropriate, consent may be requested from an individual in order to process their personal data. In such cases, an individual will be provided with information in relation to withdrawal of consent.

Data retention

Personal data will be retained for as long as the purpose the individual has provided the data for still exists, unless a longer retention period is necessary or allowed under legislation.

Data management

Processing of an individual’s personal data will be completed in accordance with the General Data Protection Regulation and any other legislation that is relevant to data protection in Poland.  Access to personal data will be restricted to authorised individuals on a strict need to know basis. The objective is to keep all personal data received in a safe and secure fashion. Appropriate technical and organisation measures are in place to in order to protect any personal data received from any unauthorised or unlawful processing.

Data sharing

Personal data may be shared so as to provide services to clients and for legitimate business purposes:

  • where permission has been received from the client.
  • to third party service providers.
  • for compliance or legal reasons, or to protect the rights of the business, clients or other parties.
  • Following a request from a court, law enforcement agency, regulatory agency, or other public and government authorities.

Individual rights

Where Benefits Services is acting as the data controller, individuals have the following rights in relation to their personal data:

  • Access – the right to request a copy of the personal data that is held.
  • Rectification – the right to have the personal data held corrected if inaccurate or incomplete.
  • Erasure – the right to have the personal data held deleted or removed if it is no longer necessary for the purpose for which it was originally intended.
  • Restricted processing – the right to request that the manner in which the personal data is used be restricted to uses which the individual may specify.
  • Data portability – where appropriate, the right to have the personal data transferred to another organisation.
  • Objection – the right to object to the processing of the personal data held in specific circumstances. An individual may withdraw consent, at any time, in respect of how personal data provided may be used.  
  • Requests received in relation to individual rights should receive a response within one month of receipt.

Outside of the EU/EEA

Personal data will only be transferred outside of the European Union and/or European Economic Area where:

  • The individual has requested.
  • The European Commission has determined that the destination of data receipt ensures an adequate level of protection.
  • Appropriate safeguards and remedies exist for the data being transferred.

Where acting on a client’s instructions personal data will only be transferred outside of the European Union and/or European Economic Area where the client has put in place the necessary safeguards.
